Mukesh Ambani, the CEO of Reliance Industries, turns 66 today, April 19, 2023. He was born on April 19, 1957, to Dirubhai and Kokilaben Ambani in Yemen. His father Dhirubhai Ambani in the year 1966 founded the Reliance Industries. In 2002, Dhirubhai passed away. Mukesh and his younger brother Anil jointly took over the reins of Reliance. Anil was appointed vice chairman and joint managing director while his older brother assumed the roles of chairman and managing director.

Anil received the financial services units, power generation, and telecommunications through a demerger, while Mukesh regained control of the petrochemicals, oil, and gas units at RIL due to a power struggle between the brothers. Mukesh Ambani identified twins Isha and Akash to take the leadership in retail and telecom last year, and his youngest son Anant for the new energy unit, as part of his succession plan for Reliance Industries Ltd.

Mukesh Amani became the country's first trillionaire in rupees in 2007. In recent months, Gautam Adani, a fellow businessman from Gujarat, has displaced him as the richest Indian. He did, however, reclaim his position as Asia's richest man in the Forbes Billionaire 2023 list, which was published on April 4. Reliance Industries, with a revenue worth $104 billion market cap with holdings in retail, petrochemicals, telecom, and oil and gas is chaired and operated by Mukesh Ambani.

His net worth is $84.1 billion, ranking him as the 13th richest billionaire in the world. He was born in Aden, Yemen. Here, his father was an attendant at a gas station. He graduated from the University of Bombay (now the University of Mumbai) with a bachelor's in chemical engineering before going on to Stanford University to acquire a master's in business administration.

The Pandemic Will Be More Deadly This Year - Look At India

Cases have been surging in the country of 1.37 billion people. On Sunday alone, 261,500 new infections were recorded. That's as bad as the U.S. during all but the worst five days of the pandemic in December and early January. Case counts are rising far more quickly, too. Average infection numbers over the past seven days have run at nearly three times the level two weeks ago, a pace of growth that the U.S. last saw in the early days of the outbreak a year ago.

The real numbers may be yet higher. The city of Bhopal used Covid-19 protocols to cremate or bury 84 people last Tuesday, according to the Hindustan Times, while declaring only five Covid deaths. The B.1.617 variant, which isn't well understood yet, has features associated with higher infection rates and lower antibody resistance. It's turning up in more than half of viral samples taken in India.

As caseloads push medical facilities toward capacity, the health system itself is starting to crack. Vaccine stocks, hospital beds and even oxygen supplies are running short, leading to bitter arguments between the states and the federal government. In some places, the dead are being transported by truck because cities have run out of hearses. Elsewhere, crematoria have started to break down because of the sheer number of bodies being burned.

If things don't change soon, the country will be facing 3,000 deaths a day -- twice its current level, and 10 times what was being seen through most of this year -- Bhramar Mukherjee, a biostatistician at the University of Michigan, wrote last week.

As my colleague Mihir Sharma has written, arrogance, hyper-nationalism and incompetence helped foster a fatal sense of complacency amid India's apparent success against the outbreak earlier this year. Until a few weeks ago, lockdown restrictions had been progressively loosening for months. Cinemas were allowed to open to full capacity Feb. 1. Health Minister Harsh Vardhan declared the country "in the endgame of the Covid-19 pandemic" in early March, at almost precisely the point that cases started to surge again.

Worryingly, the clear signs of a second wave haven't prompted much course correction since. With elections underway in the states of Assam and West Bengal, the Twitter feed of Prime Minister Narendra Modi has been interspersing updates about the virus with Trump-style footage of him, unmasked, addressing mass rallies:

The other side isn't necessarily doing much better, either. West Bengal's chief minister, an opponent of Modi's BJP, only got around to canceling her campaign rallies Sunday.

Worse may be to come. The Kumbh Mela, a Hindu pilgrimage festival that's normally the largest mass gathering on earth, is now underway on the banks of the Ganges, attended by an estimated 3.5 million people. That's well down on the numbers in a normal year, and even Modi, far too late, urged over the weekend that the event be purely "symbolic" rather than physical. Still, it's far above the mere thousands allowed to other mass events like last year's Hajj in Saudi Arabia and Arbaeen pilgrimage in Iraq.

Even held outdoors, such events carry a profound risk of spreading the most infectious variants to every corner of the country. Close to 10% of people returning to Gujarat's largest city, Ahmedabad, from the festival tested positive for Covid over the weekend, the Press Trust of India reported Monday. Hitherto, the coronavirus has mostly hit the relatively affluent, urbanized parts of the country that are best able to cope with it, such as the southern states of Kerala and Karnataka, the capital Delhi, and Maharashtra, home to Mumbai. If the Kumbh Mela seeds it in rural districts, where the majority of India's population lives, the death toll could be higher still.

There's a lesson in this for the world. The 1.2 million people who've died from Covid so far this year already represent about two-thirds of the 1.8 million fatalities in 2020. Yet people are behaving as if it's already over. That's removing the sense of unified urgency that led many nations to make such strides in turning around the pandemic last year.

Vaccine supplies for the richest (and, thanks to global initiatives, poorest) countries are relatively ample. Yet those for middle-income nations, where the majority of the planet's population lives, are grossly inadequate, blocked by restrictive patent rules. India, with one of the world's largest pharmaceutical industries, is far better placed than most midsize economies to cope, but even it is crumbling under the strain.

The more people infected in emerging countries while the rest of the world looks away, the more opportunities Covid-19 will have to develop into fresh strains and prolong this death and misery. We must do better. The globe is still under attack, but our defenses are in disarray.

RBI has released draft Frameworks for ‘Sale of Loan Exposures’ and ‘Securitisation of Standard Assets’ About: These draft guidelines are applicable to all Scheduled Commercial Banks (excluding Regional Rural Banks); All India Financial Institutions (NABARD, NHB, EXIM Bank, and SIDBI); and, all Non-Banking Financial Companies (NBFCs) including Housing Finance Companies (HFCs). The guidelines attempt to align the regulatory framework with the Basel guidelines on securitisation that have come into force effective January 1, 2018. The revisions also take into account the recommendations of the Committee on Development of Housing Finance Securitisation Market in India (Chair: Dr. Harsh Vardhan) and the Task Force on the Development of Secondary Market for Corporate Loans (Chair: Shri T.N. Manoharan), which were set up by the RBI in May, 2019.  Important Info : Salient features of draft guidelines: Only transactions that result in multiple tranches of securities being issued reflecting different credit risks will be treated as securitisation transactions.Two capital measurement approaches have been proposed: Securitisation External Ratings Based Approach (SEC-ERBA) and Securitisation Standardised Approach (SEC-SA).A special case of securitisation, called Simple, Transparent and Comparable (STC) securitisations, has been prescribed with clearly defined criteria and preferential capital treatment.The definition of securitisation has been modified to allow single asset securitisations. Securitisation of exposures purchased from other lenders has been allowed.Standard Assets would be allowed to be sold by lenders through assignment, novation or a loan participation contract . The Stressed Assets, however, would be allowed to be sold only through assignment or novation.Requirement of Minimum Retention Requirement (MRR) for sale of loans has been done away with.  Source : The Hindu (Economy) Union Finance Minister Nirmala Sitharaman has said that the COVID Emergency Credit Facility covers all companies and not just Micro, small and medium enterprises (MSMEs) About: The Emergency Credit Line Guarantee Scheme (ECLGS) is the biggest fiscal component of the Rs 20-lakh crore Self-Reliant India Mission package announced by Finance Minister last month. Under the scheme, 100 per cent guarantee coverage will be provided by National Credit Guarantee Trustee Company (NCGTC) for additional funding of up to Rs 3 lakh crore to eligible companies and borrowers, in the form of a guaranteed emergency credit line (GECL) facility. For this purpose, a corpus of Rs 41,600 crore was provided by the government, spread over the current and next three financial years. The scheme will be applicable to all loans sanctioned under GECL facility during the period from the date of announcement of the scheme to October 31 or till an amount of Rs 3 lakh crore is sanctioned under GECL, whichever is earlier. The main objective of the scheme is to provide an incentive to member lending institutions to increase access and enable availability of additional funding facility to borrowers, in view of the economic distress caused by the COVID-19 crisis.  Source : All India Radio (Economy) Delhi and the National Capital Region (NCR) have recorded at least 14 earthquakes of low or medium intensity since April, 2020 About: As per the 2002 map by the Bureau of Indian Standards (BIS), India is divided into four seismic zones – viz. The DSRV system consists of a Submarine Rescue Vessel, a Remote Operations Vehicle, Side Scan Sonar and associated equipment. It also has Diver Decompression Chambers and hyperbaric medical equipment to decompress submariners after being rescued from a sunken submarine. The DSRV system can be rapidly mobilised by air or road to facilitate submarine rescue operations even at distant locations. The Indian Navy has inducted two such systems which will provide rescue cover to submarines on the West and East coast of India respectively. The move comes as the outbreak of COVID-19 has raised global concern about illegal wildlife trade and zoonotic diseases Key highlights of advisory: The advisory defines ‘Exotic Live Species’ as animal or plant species moved from their original range (location) to a new one. ‘Exotic live species’ shall be construed to mean only “the animals named under the Appendices I, II and III of the Convention of International Trade in Endangered Species (CITES) of Wild Fauna and Flora”. Species covered by the Wildlife (Protection) Act of 1972 cannot be traded. People importing “exotic live species” will have to make a voluntary disclosure. Source : United Nations (Health) The Reserve Bank of India (RBI) released a Discussion Paper on ‘Governance in Commercial Banks in India’ for public comments About: The objective of the discussion paper is to align the current regulatory framework with global best practices while being mindful of the context of domestic financial system. Based on the feedback, fresh guidelines will be issued. The new norms will come into effect within six months after being placed the RBI’s website or April 1, 2021, whichever is later. The norms will be applicable to private, foreign and public sector banks. Some of the major highlights of the paper are as follows: Board members should not be a member of any other bank’s board or the RBI and should not be either a Member of Parliament or State Legislature or Municipality or other local bodies. Board of directors of a bank should not be less than six and not more than 15, with a majority being independent directors. The board shall meet at least six times a year and at least once every 60 days. A director on the board of an entity other than a bank may be considered for appointment as director on a bank’s board, if the person is not an owner of an NBFC or a full-time employee and that the NBFC does not enjoy a financial accommodation from the bank. Appointment, re-appointment and termination of wholetime directors (WTDs) and chief executive officers CEOs) should be with the previous approval of RBI. The upper age limit for CEO and WTDs of banks is suggested at 70 years. Banks will be free to set a lower age for such appointments. From The Bubonic Plague To COVID-19: Impact On The Legal Profession In India

The COVID-19 Pandemic has fundamentally disrupted our social and economic order. It has affected the functioning of most institutions and the Indian Judiciary is no exception. The Guardian of Law now finds itself compelled to guard against this deadly virus, its fraternity and litigants alike. The declaration of lockdown in India was accompanied with Courts across the country restricting functioning to limited matters in order to curb the number of lawyers / litigants entering court complexes. Soon, all hearings were being conducted through videoconferencing only, in order to avoid any human contact whatsoever. However, just like previous health emergencies in India like the Bubonic Plague of the late 19th century and the Spanish Flu of 1918, Corona Virus has made many its victims including the Judiciary, and the legal profession.  In order to fully appreciate the impact of the virus, the author attempts to provide an account of the effect of Covid-19 with reference to historical health emergencies and their impact on the judicial apparatus.

 Pendency in Indian Courts:

 The Indian Judiciary has been over-burdened for several years and COVID-19 is only adding to this menace. As of May 27, 2020, there are approximately 3.24 crore pending cases in India’s subordinate courts[i] and about 48.2 lakh pending cases in the High Courts[ii].

 The Supreme Court via its Notification dated March 13, 2020 restricted functioning of the Court to “ urgent matters ” only ( w.e.f.  March 16, 2020 )[iii], thereby only entertaining bail matters, suspension of sentence matters and the like.

 High Courts too have restricted their functioning to urgent matters. In normal course, a High Court hears north of 400 matters a day. However, since late March, High Courts across the country are hearing anywhere between 10-100 matters a day.[iv]

 Subordinate courts account for over 80 % of the pendency of cases. On April 30, 2020 the Karnataka High Court extended the closure of all District Courts, Family Courts, Labour Courts and Industrial Tribunals in the State until May 16, 2020[v]. On April 29, 2020 the Punjab & Haryana High Court ordered that all the district and sub-divisional Courts in Punjab, Haryana and Chandigarh will function “restrictively” from May 1 “till the lockdown / curfew is in force in the respective area”[vi]. These restrictive measures have led to a glut of pending cases, thereby increasing the burden on courts.

 Justice Delayed Is Justice Denied:

 Pendency in India’s courts has always been a hindrance in securing timely justice for people, if not denying justice altogether. As the usual functioning of courts has been disrupted, many under-trials and even many of those whose appeals are pending are left with no recourse. It can hardly be denied that the subject adage has particular force in the criminal sphere.

 In pursuance of the Apex Court’s directions dated March 23, 2020, States and Union Territories have been asked to constitute High Powered Committees “ to determine which class of prisoners can be released on parole or an interim bail for such period as may be thought appropriate. ” Therefore, each State is free to determine its own criteria for granting bail. Further the Supreme Court has clarified vide its order dated April 13, 2020 that it has not directed the States / Union Territories “ to compulsorily release the prisoners from their respective prisons.”[vii] This clarification has allowed High Courts to further restrict the nature of cases in which they are prepared to grant bail.

 On March 29, 2020, the Insolvency And Bankruptcy Board Of India announced the insertion of regulation “ 40 C ”, which laid down that the period of lockdown imposed in the wake of COVID19 shall not be counted for the purposes of the time-line for any activity that could not be completed due to such lockdown, in relation to the corporate insolvency resolution process ( CIRP )[viii]. While this move has come as a relief for companies undergoing the CIRP, it has left creditors waiting for repayment of dues for longer than the mandated 330-day period. NCLT benches across the country are hearing only urgent matters until the lockdown is lifted. This has left many other matters, which do not qualify as urgent, pending. [ix]

 Plight Of Advocates:

 A PIL was filed in the Supreme Court urging that non-payment of rent for professional premises belonging to advocates should not be made a ground for eviction, during lockdown.  However, on April 30, 2020 the Apex Court refused to entertain the plea remarking that it was "not going to enter into this issue," and dismissed the petition as withdrawn. [x] Further on May 8, 2020 a three- Judge bench of the Supreme Court dismissed a plea urging the court to direct the government to formulate a uniform welfare scheme for lawyers affected across the country.[xi]

 Daily appearances in court are the main source of income for most advocates, and cash flow has come to a drip, if not completely dried up. In the month of April, 82,725 cases were filed in India’s courts as compared to 8,80,000 cases in March [xii]. This steep decline in cases filed has consequently resulted in a significant dip in court fee, besides Lawyers’ income.

 Younger lawyers are left with little or no work. Today, a senior lawyer has the time, and the need to address minor matters, if any, personally, rather than refer them to a junior, which may have been done prior to the lockdown.

 A petition was filed in the Madras High Court, seeking a direction to the State and the Bar Council to release Rs. 50,000/-  to advocates, in order to compensate for the loss of work[xiii]. However, the Bar Council Of Tamil Nadu & Puducherry has resolved to disburse only Rs. 4000/- each to needy lawyers. The Bar Council was not in a position to release any more money because of limited resources.[xiv]

 Law Firms:

 Law Firms have also been severely affected. Many partners have either chosen to renounce salaries this financial year or agreed to take significant pay cuts.  Firms which charged clients anywhere between Rs. 20,000 and Rs 75, 000 per hour, our now renegotiating their fee, since cash-strapped clients are no longer willing to pay exorbitant sums. Moreover, clients are questioning the actual amount of time that firms are spending on their matters, thereby making firms consider implementing technology that would track the number of hours spent by an executive on a client’s job, in order to provide proof to clients[xv]. This is great innovation; however, it comes with a significant cost in a day and age when law firms are suffering unprecedented lows in business.

 Prisoners:

 Corona Virus cases have already sprung up in various jails across India. Amongst other jails, there are over 180 cases in Mumbai’s Arthur Road Jail[xvi]. Authorities have been compelled to take drastic measures such as - release a large number of inmates, shift inmates to different prisons and designate temporary places as jails for keeping new undertrials.

 By end February, nearly the cases (233 of 565) of COVID-19 reported in Wuhan, China, were from the city’s prison system.[xvii] This fact is reflective of just how dangerous prisons are today.

 Indian prisons have historically been overcrowded and may potentially become breeding grounds when threatened by a contagion like Covid19. Considering the difficult living conditions and lack of hygiene, which is an unfortunate reality of our prisons, containing the spread would become nearly impossible.

 Coping With This Challenge:

 We are now in the age of what has come to be known as “Virtual Courts ” which function through videoconferencing, e-filing, telephonic mentioning of urgent matters and online payment of court fees. These are not bereft of teething problems. Perhaps, the biggest drawback of this new system is the inability to provide public access to courtroom proceedings. Virtual proceedings are being held in camera, and are therefore not open to public which is discordant with what has been held in Naresh Shridhar Mirajkar v State of Maharashtra[xviii], where the Apex Court observed that the public has a right to be present in court and to watch proceedings.

 Lawyers are facing problems with basics such as uploading petitions on the Supreme Court website, since the data restrictions put in place are just 5 MB for a petition and 2 MB for additional documents, thereby compelling lawyers to break up the file into multiple volumes.[xix]

 Déjà Vu

 Historically, the Bubonic Plague of the late 19th century and Spanish Flu of 1918 are two points of reference when the entire framework of judiciary was disrupted on account of a health emergency.

 The arrival of the Bubonic Plague in Bombay ( now Mumbai ) in 1896, brought courts to a grinding halt. A J C Mistry, a managing clerk at the Bombay law firm, Wadia Ghandy & Co. has given a grim account of the situation in early 1897. Mistry noted that the judges of the Bombay High Court “had no work to do.” The staff of the firm returned to work after four months, however over the next decade three members fell victim to the plague and died.

Mahatma Gandhi on page 72 in his book -  The Law and The Lawyers[xx], while discussing an appeal which was to be heard in Veraval in Gujarat, writes that there were as many as fifty cases heard daily ( a lot of cases for that day and age ) in the Court at Veraval which had a population of about 5,500 people, however at the time of writing the “plague was raging ” and it was “ practically deserted ”. This anecdote bears a striking semblance to the scenario today.  

 Property which was seized in discharge of debts those days included pots, pans, utensils, bedding etc. These items were regularly hauled in and out of court. Legal historian Mitra Sharafi on page 48 in her book - Law and Identity in Colonial South Asia: Parsi Legal Culture, 1772–1947, writes that this practice of bringing property inside court rooms had become a “ particularly unsavoury phenomenon when the bubonic plague swept through the city. ”

 When the Spanish Flu arrived in 1918, the judiciary was hit once again. Jurors, lawyers and assistants of the Calcutta High Court were severely affected. The Court was functioning on somewhat similar lines of how the courts are functioning today, thereby causing consequent pendency issues. [xxi]

 Even in Bombay, law offices were bought to a standstill. In late June 1918 the Times Of India reported,

 “ Nearly every house in Bombay has some of its inmates down with [influenza] fever and every office is bewailing the absence of clerks. ”

 The flu soon found its way into jails and a need was felt to decongest prisons as inmates began to fall sick and the jails were short-staffed. The District Magistrate of Bijapur particularly wanted to release sick prisoners from jail, but the then Government was not ready to cooperate.[xxii]

 It may be relevant to mention here that an eminent lawyer by the name of, Mohandas Karamchand Gandhi was himself laid down with the Spanish flu with a faltering heartbeat. However, destiny had charted out a different path for him, and India.

 Conclusion:

This piece has only covered some of the ramifications of COVID-19 on the legal profession and there are other areas such as legal education which also need to be addressed on a priority. The existing delays in the legal system will only be exacerbated by the impediments COVID-19 will inevitably present to the progress of investigations, charging decisions, pre-trial processes etc. It appears that Corona Virus is here to stay, and the Judiciary needs to cope with it. We have been through a pandemic before and have come out of it as well. Normal functioning or rather “ New Normal ” functioning of courts is going to take its own time. Hopefully, it shouldn’t take too long, lest Lady Justice will soon have to, along with a blindfold, sword and scales, be adorned with — a mask.

Speaking to Firstpost, Bharat Biotech chairman Dr Krishna Ella, said said that COVAXIN was reported to be safe and immunogenic in all animals. "We have now moved forward towards the clinical development of this vaccine," he added. Phase 1 and 2 clinical trials of Covaxin in COVID-19 patients will begin this month. According to PTI, Zydus said that is planning to initiate the clinical trials in July 2020 across multiple sites in India in over 1,000 subjects, however, the company did not say when the vaccine will be ready for commercial use, unlike Covaxin, which is targeting for release on 15 August. PM Modi to virtually inaugurate Global Patidar Business Summit today

Prime Minister Narendra Modi will virtually inaugurate the Global Patidar Business Summit (GPBS), organized by Sardardham today.

Prime Minister will inaugurate the summit at 12 noon. The summit is being held at Surat.

Taking to Twitter, PM Modi said that the summit is aimed at encouraging entrepreneurship and value creation among the youth.

According to Prime Minister's Office (PMO), the Sardardham is organizing GPBS under 'Mission 2026' to provide an impetus to the socio-economic development of the Patidar community.

The Summit is organized every two years. The first two Summits were held in Gandhinagar in 2018 and 2020, and the current Summit is now being held in Surat.

The main theme of GPBS 2022 is "Aatmanirbhar Community to Aatmanirbhar Gujarat and India".As per the PMO, the Summit aims to bring together small, medium and large enterprises within the community; nurture and support new entrepreneurs and provide training and employment assistance to the educated youth.

The three-day Summit, being organized from April 29 to May 1, covers various aspects of government industrial policy, MSMEs, start-ups, and innovation among others.

 The Indian government had long used export processing zones (EPZs) to promote exports. Asia’s first EPZ was founded and designed in 1965 at Kandla, Gujarat state. While these EPZs had an analogous structure to SEZs, the government began to establish SEZs in 2000 under the Foreign Trade Policy.
